Intellectual Property & Content Ownership Policy
This Policy describes the general treatment of client-supplied content, commissioned deliverables, working files, reusable production methods, and third-party materials used in Moon Umlaut projects.
1. Client-Supplied Materials
Clients retain the rights they already own in their recordings, scripts, drafts, artwork, logos, episode concepts, names, guest contributions, and other supplied materials.
By supplying those materials for a project, the client authorizes Moon Umlaut to use and process them as reasonably necessary to perform the requested service.
2. Client Authority
The client is responsible for ensuring it has sufficient rights, permissions, licenses, or releases to provide source material for editing, transcription, writing, production, and publishing support.
3. Commissioned Final Deliverables
Subject to full payment and any project-specific terms, final deliverables created specifically for the client are intended for the client's use in connection with the applicable podcast, episode, or publishing activity.
If a project requires a particular assignment, license, work-for-hire arrangement, or other ownership term, that term should be stated in writing.
4. Pre-Existing Materials
Moon Umlaut retains rights in pre-existing production methods, checklists, workflows, templates, general know-how, reusable structures, technical processes, and other material that was not uniquely created as client-owned content.
5. Working and Session Files
Editing sessions, processing chains, internal notes, temporary exports, draft arrangements, templates, and other working files are not automatically included in final delivery unless specifically agreed.
6. Third-Party Music and Audio
Music, sound effects, stock audio, plugins, software, and third-party production assets may remain subject to separate licenses. Payment to Moon Umlaut does not transfer rights that Moon Umlaut does not own.
7. Third-Party Written or Visual Material
Artwork, photographs, trademarks, quotations, written excerpts, links, fonts, and other third-party materials may be subject to separate rights and restrictions. The client is responsible for confirming that the intended use is authorized.
8. Guest and Contributor Content
Guests and contributors may retain rights in their own contributions depending on the applicable agreement and law. The client should obtain appropriate releases or permissions where required.
9. Portfolio and Publicity
Moon Umlaut does not treat private or unpublished client content as public portfolio material merely because production work was performed.
Any public use of a client's name, logo, episode, confidential project, or private material for portfolio or promotional purposes should be separately authorized or otherwise lawfully available for such use.
10. Reuse of General Know-How
Providing a service to one client does not prevent Moon Umlaut from using general production knowledge, techniques, workflows, or skills on other projects, provided confidential client content is not disclosed.
11. Delivery Copies
The client should maintain its own copy of final deliverables. Ownership or usage rights in a final deliverable do not create a permanent storage obligation for Moon Umlaut.
12. Rights Concerns
If a rights concern is raised regarding supplied or produced material, Moon Umlaut may pause processing or use of the disputed material while the issue is reviewed.
